Overview
These Terms of Service ("Terms") govern your access to and use of the PaveSite platform, including the website at pavesite.com, all associated subdomains, the website builder dashboard, and the websites we host on your behalf (collectively, the "Service"). PaveSite is operated by PaveSite ("we," "us," or "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
1. Service Description
PaveSite is an AI-powered website builder designed for small businesses. The Service allows you to:
- Generate a professional website by providing your business information
- Edit your website through a conversational, chat-based interface
- Host your website on PaveSite infrastructure with a free subdomain (yourbusiness.pavesite.com) or your own custom domain
- Receive ongoing hosting, SSL certificates, and site delivery through Cloudflare's global network
PaveSite currently offers a single plan at $10 per month, which includes all features. New accounts receive a 14-day free trial with full access to the platform. No payment information is required to start a trial.
2. User Accounts
Registration
To use PaveSite, you must create an account with a valid email address. You must be at least 13 years old to create an account. If you are between 13 and 18, you must have the consent of a parent or legal guardian.
Account Security
You are responsible for maintaining the security of your account credentials. You agree to:
- Choose a strong, unique password and keep it confidential
- Notify us immediately at [email protected] if you suspect unauthorized access to your account
- Not share your account credentials with any third party
You are responsible for all activity that occurs under your account, whether or not you authorized it. We are not liable for any loss or damage arising from unauthorized use of your account.
Account Information
You agree to provide accurate and current information when creating your account and building your website. You are responsible for keeping your account information up to date.
3. Acceptable Use
You agree to use PaveSite only for lawful purposes and in accordance with these Terms. You may not use the Service to create, host, or distribute websites that:
- Contain illegal content — including content that violates any applicable local, state, national, or international law or regulation
- Infringe intellectual property — including copyrighted material, trademarks, or trade secrets belonging to others without proper authorization
- Promote spam or deceptive practices — including phishing pages, misleading claims, fake testimonials, or any form of fraud
- Contain malware or malicious code — including viruses, scripts designed to harm visitors, or redirect code to malicious sites
- Host adult or explicit content — including pornography, sexually explicit material, or content depicting graphic violence
- Promote hate or discrimination — including content that promotes hatred, violence, or discrimination against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
- Harass or threaten others — including bullying, stalking, doxxing, or personal attacks
- Sell regulated substances — including illegal drugs, controlled substances, or regulated goods without proper licensing
- Impersonate others — including creating websites that falsely represent another business, person, or organization
We reserve the right to determine, in our sole discretion, whether any content violates these guidelines. Violations may result in content removal, account suspension, or account termination.
4. Content Ownership
Your Content
You retain full ownership of all content you provide to PaveSite, including your business information, text, images, logos, and any other materials you upload or submit. By using the Service, you grant PaveSite a limited, non-exclusive, worldwide license to host, display, and distribute your content solely for the purpose of operating and providing the Service.
This license terminates when you delete your content or close your account, subject to our data retention policy as described in our Privacy Policy.
AI-Generated Content
Website content generated by our AI based on your business information is owned by you. You are free to use, modify, export, and repurpose any AI-generated text, layouts, or design elements created for your website. However, you are responsible for reviewing AI-generated content for accuracy before publishing.
PaveSite Intellectual Property
The PaveSite platform, including its software, design, templates, logos, and documentation, remains the intellectual property of PaveSite. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.
5. Service Availability and Modifications
Uptime
We strive to maintain high availability for all websites hosted on PaveSite. Our infrastructure is built on Cloudflare's global network, which provides robust reliability and performance. However, we do not guarantee 100% uptime. The Service may be temporarily unavailable due to:
- Scheduled maintenance (we will provide advance notice when possible)
- Unscheduled maintenance to address critical security or performance issues
- Factors beyond our control, including internet infrastructure failures, natural disasters, or third-party service outages
Service Changes
We may modify, update, or discontinue features of the Service at any time. If we make material changes that negatively affect your use of the Service, we will provide at least 30 days' notice via email. We will not remove core functionality (website hosting, editing, or custom domains) without providing a reasonable migration path or alternative.
Pricing Changes
We may change our pricing in the future. Any price increases will be communicated at least 30 days in advance and will not apply to your current billing cycle. You will have the option to cancel before the new pricing takes effect.
6. Payment Terms
Free Trial
New accounts include a 14-day free trial with full access to all features. During the trial you receive unlimited chat-based edits. No payment information is required to start a trial. At the end of your trial, you must subscribe to continue using the Service. If you do not subscribe, your site will go offline but your data will be preserved for 90 days.
Subscription
After the free trial, PaveSite costs $10 per month, billed monthly. Payment is processed through Stripe, a PCI-compliant payment processor. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.
Failed Payments
If a payment fails, we will attempt to process the charge again over the following 7 days. If all attempts fail, your account will be moved to a suspended state. Your site will go offline, but your data will be preserved for 90 days. You can reactivate at any time by updating your payment information.
Taxes
The stated price does not include applicable taxes. You are responsible for paying any sales tax, VAT, or other taxes required by your jurisdiction. Stripe may add applicable taxes to your invoice based on your billing address.
7. Cancellation and Refund Policy
Cancellation
You may cancel your subscription at any time through your PaveSite dashboard or by contacting [email protected]. Cancellation takes effect as follows:
- During free trial — Your account is deactivated immediately. No charges are incurred.
- During paid subscription — Your site remains live through the end of your current billing period. You will not be charged again after cancellation.
Refunds
If you cancel within the first 7 days of your initial paid subscription (i.e., the first billing cycle after your free trial), you may request a full refund by emailing [email protected]. After the first 7 days of your paid subscription, payments are non-refundable. We do not provide partial refunds for unused portions of a billing period.
After Cancellation
When your subscription ends:
- Your website goes offline and is no longer accessible to visitors
- Your custom domain configuration is preserved but inactive
- Your account data, site content, and edit history are retained for 90 days
- You may request an export of your site code (HTML/CSS) and uploaded assets at any time during this 90-day period
- After 90 days, your data is permanently deleted
- Any custom domain you registered externally remains yours — we do not claim ownership of your domain
8. Content Moderation and Takedown
Automated Moderation
PaveSite uses automated content moderation powered by Anthropic to screen website content for violations of our acceptable use policy. This moderation occurs when sites are created and when significant content changes are made through the chat editor.
Manual Review
Our team may manually review websites that are flagged by automated systems or reported by third parties. If we determine that content violates our Terms, we will take appropriate action, which may include:
- Notifying you of the violation and requesting that you remove or modify the content within a reasonable timeframe
- Temporarily taking your site offline while the issue is resolved
- Removing specific content that violates these Terms
- Suspending or terminating your account for severe or repeated violations
Takedown Requests
If you believe a website hosted on PaveSite infringes your intellectual property or otherwise violates the law, you may submit a takedown request to [email protected]. Please include:
- The URL of the content in question
- A description of the alleged violation
- Your contact information
- For copyright claims, a statement under penalty of perjury that you are the copyright owner or authorized to act on behalf of the owner
We will review all takedown requests promptly and respond within 5 business days.
Appeals
If your content is removed or your account is suspended, you may appeal the decision by emailing [email protected] with an explanation of why you believe the action was taken in error. We will review appeals within 10 business days.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
- We do not warrant the accuracy, reliability, or completeness of any AI-generated content. You are solely responsible for reviewing and verifying all content published on your website.
- In no event shall PaveSite, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of profits, loss of business, loss of data, or loss of goodwill, arising out of or in connection with your use of the Service.
- Our total aggregate liability for any claims arising out of or related to these Terms or the Service shall not exceed the total amount you paid to PaveSite in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless PaveSite and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Content you publish or host through PaveSite
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Any claim that your content caused damage to a third party
11. Termination
We may suspend or terminate your account at any time if:
- You violate these Terms or our acceptable use policy
- You fail to pay subscription fees after the grace period
- We are required to do so by law or a valid legal order
- Your account appears to be compromised and poses a security risk
If we terminate your account for a reason other than a Terms violation, we will provide a prorated refund for any unused portion of your current billing period. If your account is terminated due to a violation of these Terms, no refund will be issued.
Upon termination, your website will be taken offline. Your data will be retained for 30 days to allow you to request an export, unless retention is prohibited by law or a legal order. After 30 days, your data will be permanently deleted.
12. Dispute Resolution
If a dispute arises between you and PaveSite, we encourage you to first contact us at [email protected] to attempt to resolve the issue informally. Most concerns can be resolved quickly through direct communication.
If informal resolution is not successful, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the English language, and the arbitrator's decision shall be final and binding.
You agree that any dispute resolution proceedings will be conducted on an individual basis, not as a class action, collective action, or representative action.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the federal or state courts located in the State of Delaware.
14. General Provisions
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and PaveSite regarding the Service and supersede all prior agreements, understandings, and communications.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets without your consent, provided that the assignee agrees to honor these Terms.
Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms due to events beyond our reasonable control, including natural disasters, acts of government, internet failures, power outages, pandemics, or acts of terrorism.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you via email or through a prominent notice in the PaveSite dashboard at least 30 days before the changes take effect. Continued use of the Service after the effective date of revised Terms constitutes acceptance of those Terms.
We encourage you to review these Terms periodically. The "Last updated" date at the top of this page indicates when these Terms were most recently revised.
